Early Patterns in the New Section 11(b) Framework

    Abstract

    The Supreme Court's decision in R. v. Jordan , completely restructuring the approach to assertions of the right to a trail within a reasonable time, has so far had an enormous impact on the workload of courts, as completed section 11(b) applications are re-argued under the new framework and as new applications are brought based on the new formulation of the right. What is still unclear, however, is the extent to which Jordan will actually end up having an impact on the right to a trial within a reasonable time itself.
